Monday morning on FOX and Friends, co-host Brian Kilmeade repeated something about the ACA that has been debunked for a few years.
Bret Baier said ObamaCare’s individual mandate requires uninsured Americans to get Health coverage by March. If you do not, you will face a fee of $95 or 1% of your annual income.
They were doing fine, until Kilmeade stepped in:
A $95 fine which a lot of young people are going to take in order to avoid prison time or whatever ramifications…
The law prohibits criminal penalties in this case. It’s right in the bill (page 131).
WAIVER OF CRIMINAL PENALTIES
.—In the case ofany failure by a taxpayer to timely pay any penalty imposedby this section, such taxpayer shall not be subject to anycriminal prosecution or penalty with respect to such failure.‘‘(B) LIMITATIONS ON LIENS AND LEVIES.—The Secretary shall not—‘‘(i) file notice of lien with respect to any propertyof a taxpayer by reason of any failure to pay thepenalty imposed by this section, or‘‘(ii) levy on any such property with respect to such failure.’’.
According to politifact, this would happen:
The law would allow the government to collect the tax by deducting it from any IRS tax-refund checks or other government payments.
